Aristoqle Terms of Use
Status: draft for legal review. Version: draft-2026-10. English translation of Terms_hr.md. If the two differ, the Croatian text prevails. The text follows how the platform works on 24 October 2026. A legal adviser must review it before publication. Items in square brackets are to be filled in; those marked [CHECK] depend on decisions or facts not confirmed at the time of writing.
The version label is stored with every sign-up (setting Signup:TermsVersion). When the text changes, the label changes too.
1. Who provides the service
The Aristoqle platform (the Platform) is provided by Smak kolektiv d.o.o., [address], OIB [ ], e-mail [contact] (the Provider).
These terms govern the relationship between the Provider and the organisation that opens an account on the Platform (the Customer).
2. Who the service is for
2.1. The Platform is meant for organisations for their business, not for personal use. Examples: museums, libraries, parks, tourist boards, associations, educational and similar institutions, and companies.
2.2. The person opening the account confirms that they are of age and authorised to accept these terms on behalf of the organisation they name. If they are not authorised, they are personally liable for the consequences.
2.3. One organisation may have only one free account. [CHECK: whether consumer protection law applies to Customers who are natural persons; if so, add to or exclude such sign-ups.]
3. The account
3.1. At sign-up the Customer enters accurate data: the organisation's name, the person's name and their work e-mail address. The Customer keeps these data up to date.
3.2. After sign-up the Platform sends a link to confirm the e-mail address. The account works before confirmation, but without artificial intelligence. An account whose address is not confirmed within 30 days may be deleted with all its content.
3.3. The person who opens the account becomes its owner. The owner can add other users as owners or editors. An editor creates content. An owner also manages users, deletes units and sees the credit balance. The plan limits the number of users.
3.4. Each user has their own sign-in. Users keep their passwords to themselves and do not share them. The Customer is responsible for actions taken with its users' accounts.
3.5. If the Customer suspects unauthorised access, it changes the password at once and informs the Provider. Changing a password ends all of that user's other open sessions.
4. Plans and limits
4.1. A new account starts on the Free plan, which includes:
- one unit with up to five activities;
- one content language;
- one user;
- up to 500 visitor sessions a month;
- the "Made with Aristoqle" mark on visitor pages.
The points portal and the export of a unit as a web package for the Customer's own server are not included. Downloading content (article 6.7) is available on every plan.
4.2. The paid plans (Starter, Plus, Institution) and their prices are published at [aristoqle.com/pricing]. A paid plan is agreed by quote or pro-forma invoice. The Provider switches it on after payment, for the period stated in the quote. [CHECK: payment terms, renewal, VAT.]
4.3. When a paid plan expires and is not renewed, the account moves to the Free plan. Content is not deleted. New content can only be created within the Free plan's limits. The Provider reminds the account owners of the end by e-mail 30, 7 and 1 day before it, and in the administration from 30 days before it.
4.4. The Platform itself prevents actions beyond the plan's limits, for example creating a second unit on the Free plan. Visitor sessions are only counted: visitors are never stopped. When the monthly number is exceeded, the Provider sends a notice and may suggest a better-fitting plan.
4.5. The Provider may change the limits and contents of plans. Changes to a paid plan that are unfavourable to the Customer take effect from the next billing period.
4.6. The Institution plan is agreed for one institution (one legal entity) and its locations named in the quote. The number of units and users on that plan is not limited. The units must be that institution's content, and the users its staff or collaborators who create content for it. Several institutions, a network or an association, as well as content made for other organisations, need a separate quote. The storage limit and the AI credit apply on this plan too.
5. AI credit
5.1. Creating content with artificial intelligence (text, images, translation, narration) uses credit. Credit is expressed in euros. The price of each step is shown on the "Credits" page, with the balance and a list of calls.
5.2. The Free plan's starting credit is granted after the e-mail address is confirmed and the Provider has reviewed the account. The Provider grants it at its discretion and may refuse it without giving reasons, in particular when:
- the same address or domain has already received a starting credit;
- several accounts were opened from the same network;
- the data are clearly inaccurate.
The starting credit is granted once per organisation. An account without credit keeps working, without artificial intelligence.
5.3. Paid plans include a yearly credit as stated in the price list. [CHECK: whether unused credit carries over to the next period.]
5.4. Credit is not money. It is not paid out, refunded, transferred to another account or exchanged for other services.
5.5. A call is refused before it is sent if it could cost more than the remaining credit. The Provider may also limit daily and monthly spending and the number of simultaneous calls.
5.6. A call that was sent to the AI provider but whose outcome is unknown is charged at the estimate. This happens when the connection breaks or the user closes the page. A call that was not processed is not charged.
5.7. The Provider may change step prices. A new price applies only to calls made after the change. Calls already charged do not change.
6. The Customer's content
6.1. The Customer keeps all rights to the content it uploads or creates: texts, documents, images, sound and links.
6.2. The Customer grants the Provider a non-exclusive, free right to store, process, adapt for display and show that content to visitors, to the extent needed to provide the service and for as long as it lasts. This includes sending content to the sub-processors named in the privacy notice, in particular to the AI provider when the Customer starts a generation.
6.3. The Customer warrants:
- that it may use the content it uploads, including content from web addresses it enters;
- that the content does not infringe the rights of others or the law.
The Customer does not upload special categories of personal data, or personal data of children, unless it has a legal basis to do so.
6.4. The Provider does not review the Customer's content before publication and does not take editorial responsibility for it. It handles reported content under article 6.6.
6.5. The Provider may use aggregate usage data that reveal neither the Customer nor any person, to maintain and develop the service. It uses the Customer's name as a reference only with the Customer's consent.
6.6. Reports and removal of content. Anyone can report content with the "Report content" link under every game. The Provider reviews reports diligently and objectively. If it finds the content unlawful or contrary to these terms, it may take the unit off public access: visitors can then no longer open it, while the Customer can still see and edit it. For every removal the Provider e-mails the account owners a statement of reasons: what was removed and since when, that the decision followed a report, the facts and circumstances, the ground (unlawful content or a breach of these terms), that the decision was not made by an automated system, and how to object. The statement is also shown on the unit's page in the administration. The Customer objects by replying to that message; the Provider considers the objection and, if it is justified or the content has been corrected, puts the unit back and tells the owners. The Customer may also turn to the competent court. Every decision is recorded. [CHECK: compliance with Art. 16, 17 and 20 of the Digital Services Act, and the exemption of micro and small enterprises in Art. 19.]
6.7. Downloading content. At any time and on every plan, the Customer can download the content of each unit ("Download content"): the texts in every language as JSON, and the pictures and sounds. Exporting a unit as a web package that the Customer publishes on its own server is part of the Institution plan.
7. AI-generated content
7.1. Artificial intelligence makes mistakes: it can state wrong facts, mistranslate, or produce an unsuitable image or text.
7.2. That is why the Platform saves such content as a draft. Visitors see it only after one of the Customer's users has reviewed it and marked it as verified. Every status change is recorded.
7.3. The Customer bears full editorial responsibility for content it approves. The Platform visibly marks to visitors content made with the AI creation tool, pictures made by artificial intelligence and machine translations, and marks generated pictures and audio in a machine-readable way as well.
7.4. Translations of the content into other languages are made by artificial intelligence, when the Customer asks for them or switches on automatic translation. They are not saved as drafts; the Customer should check them just like the original content.
8. Prohibited use
The Customer must not use the Platform for:
- publishing unlawful, misleading, offensive or discriminatory content, or content that infringes the rights of others;
- phishing, collecting other people's sign-in or payment data, spreading malware or spam;
- opening several free accounts for the same organisation, or otherwise getting around plan and credit limits;
- automated sign-up, automated requests, overloading, vulnerability testing without written permission, or attempts to access other customers' data;
- reselling or handing access to third parties without agreement with the Provider.
9. Blocking and termination
9.1. The Provider may block an account if:
- the Customer breaches these terms;
- there is reasonable suspicion of abuse or fraud;
- a paid plan is not paid.
It may do so without prior notice where needed to protect the Platform, visitors or third parties. A blocked account cannot sign in, and its public pages are not available to visitors. The Provider informs the Customer of the block, unless that would hinder stopping the abuse.
9.2. The Customer may close the account at any time. The account owner does it on the "My account" page, confirming with the password; otherwise by written request to the Provider's contact. Closing takes effect at once: nobody can sign in any more and the units are no longer available to visitors. Amounts paid for the current period are not refunded unless agreed otherwise.
9.3. The content and user accounts of a closed account are deleted 30 days after closing, and from backups when their retention period ends. Until then the Provider can reopen the account at the Customer's request. The same applies when the Provider closes the account. The Customer should download any content it wants to keep before closing (article 6.7).
9.4. The Provider may shut down a free account that has not been used for more than [12] months, after at least 30 days' notice by e-mail. [CHECK: the Platform does not do this yet.]
10. Availability and changes to the service
10.1. The Provider aims to keep the Platform available but does not guarantee uninterrupted operation. It guarantees no level of availability for the Free plan. For paid plans a service level may be agreed separately.
10.2. The Provider develops the Platform and may change, add or remove features. Removing a feature essential to a paid plan is announced at least 30 days in advance.
10.3. The Platform is provided as is and as available. The Provider does not guarantee:
- that the Platform will work without interruption or errors;
- that it will suit any particular purpose of the Customer;
- that AI-generated content will be accurate.
10.4. The Platform's operation may be interrupted by maintenance, upgrades, faults and attacks. It may also be interrupted by outages of third-party services: the hosting, AI, e-mail and network providers. Such interruptions are not a breach of these terms. The Provider tries to carry out planned maintenance outside usual working hours and announces it in advance in the administration. During maintenance the Platform shows users and visitors a maintenance notice.
10.5. The Provider makes regular backups, but the Customer must keep its own copies of the original materials (texts, images, documents) it uploads to the Platform.
11. Liability
11.1. The Provider is not liable for damage caused by:
- the Customer's content, including AI-generated content the Customer approved, and the consequences of publishing it;
- unavailability, interruptions, slowness or errors of the Platform;
- loss of or damage to data, except to the extent it can be restored from backups;
- outages or actions of third parties whose services the Platform uses;
- force majeure, attacks on the system or other circumstances beyond the Provider's reasonable control;
- the Customer's inaccurate data or unauthorised use of its password;
- blocking of the account under article 9.
In no case is the Provider liable for lost profit, lost revenue, reputation or data, or any other indirect or consequential damage.
11.2. The Free plan is free of charge. For it, the Provider's liability is excluded to the extent the law allows.
11.3. For paid plans, the Provider's total liability on all grounds together is limited to the amount the Customer paid for the Platform in the 12 months before the event that caused the damage.
11.4. The Customer must submit any damage claim to the Provider in writing within [3] months of learning of the damage. [CHECK: whether a contractual time limit is permitted.]
11.5. The limits and exclusions in this article do not apply to damage the Provider causes intentionally or by gross negligence, or to damage for which the law does not allow liability to be limited. [CHECK: compliance with Art. 345 of the Croatian Civil Obligations Act.]
11.6. The Customer indemnifies the Provider for damage and costs, including legal fees, arising from third-party claims connected to the Customer's content or to a breach of article 8.
12. Personal data
12.1. The Provider processes data of people who work in the Platform's administration as a controller, as described in the Privacy notice for administration users ([link]).
12.2. The Provider processes data of visitors to the Customer's content on the Customer's behalf, as a processor. That processing is governed by the Data Processing Agreement ([link]), which forms part of these terms. [CHECK: whether accepting the terms at sign-up satisfies Art. 28 GDPR or a separate signature is needed.] Visitors are informed at /Privacy.
13. Changes to these terms
13.1. The Provider may change these terms. It informs the Customer by e-mail to the owner's address and in the administration, at least 30 days before the changes take effect.
13.2. A Customer who does not agree may close the account before the changes take effect. Continued use after that date means acceptance.
14. Governing law and disputes
These terms are governed by the law of the Republic of Croatia. The parties try to settle disputes by agreement. If they cannot, the competent court in [Zagreb] decides. [CHECK]
These terms apply from [date].
